PERTANGGUNGJAWABAN PIDANA TRADING IN INFLUENCE DALAM PERSPEKTIF KEKOSONGAN NORMA HUKUM

Tujuan penelitian ini adalah untuk mengkaji serta menganalisis pengaturan hukum terkait trading in influence beserta bentuk pertanggungjawaban pidananya dalam konteks adanya kekosongan norma hukum di Indonesia. Penelitian ini menggunakan metode hukum normatif dengan pendekatan perundang-undangan, konseptual, dan komparatif. Kajian difokuskan pada ketentuan hukum yang berlaku, baik dalam Undang-Undang Tindak Pidana Korupsi maupun instrumen internasional seperti United Nations Convention Against Corruption (UNCAC). Hasil penelitian menunjukkan bahwa meskipun UNCAC telah secara jelas mengatur trading in influence sebagai salah satu bentuk tindak pidana korupsi, hukum positif di Indonesia hingga saat ini belum secara tegas mengadopsi ketentuan tersebut ke dalam rezim tindak pidana korupsi. Kondisi ini menimbulkan kekosongan norma yang berimplikasi pada lemahnya kepastian hukum, sekaligus membuka celah dalam penegakan hukum terhadap praktik penyalahgunaan pengaruh yang merugikan kepentingan publik. Oleh karena itu, pengaturan mengenai trading in influence dalam sistem hukum pidana Indonesia menjadi sangat mendesak, baik sebagai upaya pencegahan maupun penindakan dalam pemberantasan korupsi.
ABSTRACT
The purpose of this study is to examine and analyze the legal framework regarding trading in influence and its forms of criminal liability in the context of a legal vacuum in Indonesia. This study employs a normative legal methodology using legislative, conceptual, and comparative approaches. The study focuses on applicable legal provisions, both in the Corruption Crimes Act and international instruments such as the United Nations Convention Against Corruption (UNCAC). The results of the study indicate that although the UNCAC has clearly defined trading in influence as a form of corruption, Indonesian positive law has not yet explicitly incorporated these provisions into the criminal regime for corruption. This situation creates a legal vacuum that results in weak legal certainty, while simultaneously opening loopholes in law enforcement against the practice of influence peddling that harms the public interest. Therefore, the regulation of trading in influence within the Indonesian criminal law system has become urgently necessary, both as a preventive measure and as a means of enforcement in the fight against corruption.
