Penelitian ini mengkaji problematika ketidaksinkronan norma antara Peraturan Menteri Keuangan dan Undang-Undang Jabatan Notaris (UUJN) dalam mengatur peran Notaris sebagai Pejabat Lelang Kelas II. Ketidaksesuaian pengaturan tersebut berpotensi menimbulkan ketidakpastian hukum, terutama terkait sumber kewenangan, mekanisme pengangkatan, serta sistem pembinaan dan pengawasan. Penelitian ini bertujuan untuk menganalisis bentuk ketidaksinkronan norma serta merumuskan desain sinkronisasi hukum yang ideal dalam sistem hukum nasional. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan analitis. Hasil penelitian menunjukkan bahwa terdapat ketidaksinkronan vertikal dan substansial antara Peraturan Menteri Keuangan dengan UUJN, yang menempatkan Notaris dalam posisi administratif sehingga berpotensi mereduksi statusnya sebagai pejabat umum. Oleh karena itu, diperlukan desain sinkronisasi yang menempatkan UUJN sebagai dasar normatif utama, sementara Peraturan Menteri Keuangan berfungsi sebagai pengaturan teknis administratif. Sinkronisasi ini penting untuk menjamin kepastian hukum, perlindungan profesi Notaris, dan konsistensi sistem hukum lelang nasional.
This study examines the issue of normative inconsistency between the Ministry of Finance Regulations and the Notary Position Act (UUJN) in regulating the role of Notaries as Class II Auction Officers. Such inconsistencies potentially create legal uncertainty, particularly concerning the source of authority, appointment mechanisms, and systems of supervision. This study aims to analyze the forms of normative inconsistency and formulate an ideal legal synchronization design within the national legal system. The research employs a normative legal method with statutory, conceptual, and analytical approaches. The findings reveal both vertical and substantive inconsistencies between the Ministry of Finance Regulations and UUJN, which tend to position Notaries in an administrative role that may diminish their status as public officials. Therefore, a legal synchronization model is required by placing UUJN as the primary normative foundation, while the Ministry of Finance Regulations serve as technical-administrative instruments. This synchronization is essential to ensure legal certainty, protect the Notary profession, and maintain consistency in the national auction law system.
