KOMPETENSI ABSOLUT PERADILAN TATA USAHA NEGARA DALAM MENGADILI GUGATAN WARGA NEGARA (CITIZEN LAWSUIT)

Abstract

Penelitian ini bertujuan untuk mengidentifikasi objek dan subjek gugatan warga negara terhadap UU PTUN guna menjamin kepastian hukum mengenai kompetensi absolut Peradilan Tata Usaha Negara. Metode yang digunakan dalam penelitian ini adalah normatif dengan pendekatan Peraturan Perundang-undangan, doktrin para ahli tentang gugatan warga negara dan objek PTUN. Hasil penelitian menujukan adanya pengaturan secara jelas mengenai gugatan warga negara, adanya kesesuaian terhadap pengaturan kompetensi absolut Pengadilan TUN dalam mengadili perkara lingkungan hidup, serta adanya korelasi pengaturan pengajuan gugatan warga negara atas unsur pembiaran atau tidak dilaksanakannya kewajiban oleh pemerintah dengan UU Perlindungan dan Pengelolaan Lingkungan Hidup yang menjadi dasar perluasan kompetensi absolut Pengadilan TUN.

This study aims to identify the objects and subjects of citizens lawsuits against the Administrative Court Law in order to ensure legal certainty regarding the absolute competence of the Administrative Court. The method used in this research is normative with the approach of legislation, doctrine of experts on citizen lawsuits and the object of PTUN. The results of the research indicate that there is a clear regulation of citizen lawsuits, the existence of conformity to the regulation of the absolute competence of the Administrative Court in adjudicating environmental cases, and the correlation of the regulation of filing citizen lawsuits on the element of omission or non-performance of obligations by the government with the Perlindungan dan Pengelolaan Lingkungan Hidup Law which is the basis for expanding the absolute competence of the Administrative Court.
