PERLINDUNGAN KEPASTIAN HUKUM PEMEGANG HAK CIPTA ATAS TRANSFORMASI MUSIK OLEH ANONIM DI MEDIA SOSIAL

Abstract

Tujuan studi ini untuk menganalisis kepastian hukum perlindungan bagi pemegang Hak Cipta atas transformasi musik oleh anonim di media sosial. Studi ini menggunakan metode penelitian normative dengan pendekatan perundang-undangan dan pendekatan konseptual. Hasil studi menunjukan bahwa kepastian hukum bagi pemegang hak cipta atas karya musik yang ditransformasikan diatur dalam Pasal 40 ayat (1) huruf n Undang-Undang Nomor 28 Tahun 2014 Tentang Hak Cipta (UUHC). Pemegang Hak Cipta memiliki Hak Ekslusif yakni hak moral dan hak ekonomi terhadap karya ciptaanya. Sehingga pihak lain yang menggunakan untuk kepentingan komersial tanpa seizin pemegang Hak Cipta adalah perbuatan pelanggaran yang konsekusensinya dapat digugat perdata berupa ganti rugi maupun dikenakan sanksi pidana berdasarkan pasal 99 Ayat (1) maupun sanksi pidana diatur dalam Pasal 113 Ayat (2) UUHC. Berkaitan dengan pencegahan pelanggaran transformasi musik oleh anonym, penting diatur ketentuan secara eksplisit mengenai pengaturan tentang mekanisme pelacakan secara digital untuk menelusuri identitas dibalik akun anonim, dalam rangka kepastian hukum perlindungan bagi pemegang hak cipta.

ABSTRACT

The purpose of this study is to analyze the legal certainty of protection for Copyright holders for anonymous music transformation on social media. This study uses a normative research method with a statue approach amd conceptual approach. The results of the study indicate that legal certainty for copyright holders for transformed musical works is regulated in Article 40 paragraph (1) letter n of Law Number 28 of 2014 concerning Copyright (UUHC). Copyright holders have Exclusive Rights, namely moral rights and economic rights to their creative works. So that other parties who use it for commercial purposes without the permission of the Copyright holder are committing an act of violation (Article 9), the consequences of which can be sued for civil damages under Article 99 Paragraph (1) as well as subject to criminal sanctions based on Article 113 Paragraph (2) UUHC. Related to the prevention of violations of the music transformation by the anonymuos it is important to explicitly regulate provisions regarding the regulation of digital tracking mechanisms to trace the identity behind anonymous accounts, in the context of legal certainty protection for copyright holders.
