Abstract

Penelitian ini bertujuan menganalisis batas penerapan force majeure, bentuk wanprestasi, serta konstruksi tanggung jawab hukum PPIU dan perusahaan asuransi syariah dalam perjanjian perjalanan ibadah umrah di Indonesia. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach). Bahan hukum primer meliputi ketentuan hukum perjanjian dalam Kitab Undang-Undang Hukum Perdata, peraturan mengenai penyelenggaraan perjalanan ibadah umrah, serta ketentuan yang berkaitan dengan asuransi syariah. Bahan hukum sekunder berupa buku, jurnal ilmiah, dan doktrin hukum yang relevan dianalisis secara yuridis kualitatif. Hasil penelitian menunjukkan bahwa force majeure tidak dapat dipandang secara otomatis sebagai alasan yang menghapus seluruh tanggung jawab kontraktual. Penerapannya harus dinilai berdasarkan sifat peristiwa, kemampuan pihak untuk mencegah atau mengatasi akibat peristiwa tersebut, ketentuan kontrak, serta hubungan kausal antara keadaan memaksa dan kegagalan memenuhi prestasi. Tanggung jawab PPIU dan perusahaan asuransi juga harus dibedakan berdasarkan sumber kewajiban masing-masing. PPIU bertanggung jawab atas kewajiban penyelenggaraan perjalanan yang diperjanjikan, sedangkan perusahaan asuransi bertanggung jawab berdasarkan risiko yang dijamin, akad, dan ketentuan polis. Oleh karena itu, diperlukan perumusan klausul force majeure dan perlindungan asuransi yang lebih jelas agar memberikan kepastian hukum dan perlindungan yang proporsional bagi jemaah umrah.

This study aims to analyze the limits of force majeure, forms of breach of contract, and the legal liability of PPIU and sharia insurance companies in Umrah travel agreements in Indonesia. This study employs normative legal research using a statutory approach and a conceptual approach. Primary legal materials include the provisions of contract law under the Indonesian Civil Code, regulations governing Umrah travel organization, and provisions relating to sharia insurance. Secondary legal materials consist of relevant books, scholarly articles, and legal doctrines, which are analyzed using qualitative juridical analysis. The results indicate that force majeure cannot automatically be regarded as a ground for eliminating all contractual liability. Its application must be assessed based on the nature of the event, the parties' ability to prevent or overcome its consequences, the contractual provisions, and the causal relationship between the force majeure event and the failure to perform the contractual obligation. The liability of PPIU and insurance companies must also be distinguished according to the respective sources of their obligations. PPIU is responsible for the travel services and obligations stipulated in the agreement, whereas insurance companies are liable based on the risks covered, the applicable insurance contract, and the terms and conditions of the policy. Therefore, clearer formulation of force majeure clauses and insurance protection is necessary to ensure legal certainty and proportionate protection for Umrah pilgrims.
