PERSPEKTIF GENDER: MENYOROTI PERKAWINAN DENGAN KERIS MASYARAKAT ADAT BALI

Abstract

Penelitian ini bertujuan untuk menganalisis norma konflik antara pengaturan perkawinan dalam hukum nasional dengan perkawinan dalam hukum adat Bali. Berlandaskan banyaknya pasal yang masih bias gender dan patriarki, misalnya di syarat poligami, syarat umur, kedudukan suami dan istri, penelitian difokuskan pada perspektif gender, ketidakadilan yang ditempuh oleh perempuan akibat dari konflik norma. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan, pendekatan kasus, dan pendekatan konseptual. Hasil penelitian ini menunjukkan bahwa kebiasaan masyarakat setempat yang telah lama berlangsung tidak dapat dipungkiri dengan mudah. Dalam konteks bahwa perkawinan dengan simbol keris yang meskipun tidak sesuai dengan hukum nasional, tetap lumrah dilakukan masyarakat di Bali dan tetap sah sesuai dengan teori keberlakuan hukum.

ABSTRACT

This study aims to analyze the conflict of norms between marriage regulations in national law and marriage in Balinese customary law. Based on the numerous articles that are still gender-biased and patriarchal, for example regarding polygamy requirements, age requirements, and the positions of husband and wife, the study focuses on a gender perspective, especially the injustice experienced by women due to norm conflicts. This research uses a normative juridical method with legislative, case, and conceptual approaches. The results of this study show that the long-standing customs of the local community cannot be easily denied. In the context of marriage with the keris symbol, although it does not align with national law, it is still commonly practiced by the Balinese community and remains valid according to the theory of legal effectiveness.
