ANALISIS YURIDIS PENGATURAN PERALIHAN PROTOKOL NOTARIS OLEH MAJELIS PENGAWAS NOTARIS DITINJAU DARI UNDANG-UNDANG JABATAN NOTARIS

Abstract

Artikel ini bertujuan menganalisis pengaturan peralihan protokol notaris kepada notaris lain yang ditetapkan oleh Majelis Pengawas Daerah (MPD) serta mengkaji akibat hukum penolakan penetapan penerima protokol. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan peraturan perundang-undangan dan pendekatan konseptual. Hasil kajian menunjukkan bahwa penetapan MPD berfungsi menjamin kesinambungan pengelolaan arsip negara dan akses layanan salinan/kutipan akta, yang wajib diwujudkan melalui serah terima protokol dalam berita acara dan pencatatan administratif. Penolakan dapat dikualifikasikan sebagai ketidakpatuhan terhadap kewajiban jabatan dan berimplikasi pada pemeriksaan serta sanksi administratif, namun penilaiannya tetap harus proporsional dengan mempertimbangkan kapasitas objektif notaris penerima serta asas kepastian hukum dan akuntabilitas.

ABSTRACT

This article aims to examine the legal regulation of transferring a notary protocol to another notary appointed by the Regional Supervisory Council (MPD) and to identify the legal consequences of refusal by the appointed notary. The study uses normative legal research with statutory and conceptual approaches. The findings show that the MPD’s appointment functions to ensure continuity of state-archive management and public access to copies/extracts of deeds, which must be implemented through a formal handover report and administrative registration. Refusal may be classified as non-compliance with official duties and lead to supervisory examination and administrative sanctions, although assessment should remain proportional by considering the recipient notary’s objective capacity and the principles of legal certainty and accountability.
