This study aims to analyze the regulation of registration of Management Rights (Hak Pengelolaan/HPL) over Minangkabau customary land under the national land law system and to formulate a reconstruction of its registration to ensure legal certainty and justice for indigenous communities. This study employs normative legal research with a prescriptive character using statutory, conceptual, historical, and comparative approaches, supported by interviews with academics, land officials, local government representatives, and indigenous community leaders. The findings indicate that the registration of HPL over customary land is legally grounded in Government Regulation Number 18 of 2021, Presidential Regulation Number 62 of 2023, West Sumatra Regional Regulation Number 7 of 2023, and Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Number 14 of 2024. However, its implementation continues to face several obstacles, including the absence of clear recognition of indigenous community subjects, limited dissemination of information, difficulties concerning genealogical records, differences between customary and administrative land boundaries, and community concerns regarding the potential alteration of the communal character of customary land. These conditions reveal a tension between the need for administrative certainty and the protection of indigenous communities’ ancestral rights. Reconstruction is therefore required with respect to Article 4 and Article 5 paragraph (2) of Government Regulation Number 18 of 2021 by affirming that HPL over customary land does not extinguish the ancestral rights of indigenous communities and that its determination should not operate automatically. Registration should instead strengthen communal recording through a Customary Land Register, while HPL should function as an administrative instrument available upon application by the indigenous community. Accordingly, registration should serve not as an instrument of privatization or transformation of customary rights, but as a legal protection mechanism integrating administrative certainty with substantive justice.
