The research analyzes land ownership disputes involving Foreign Nationals (WNA) in Indonesia from a land law perspective, incorporating a case study of Decision No. 259/Pdt.G/2020/PN.Gin alongside a comparative analysis with the Malaysian land law system. Utilizing normative legal research methods with statutory, case-based, and comparative approaches, this study reveals that the Basic Agrarian Law (UUPA) No. 5 of 1960 strictly prohibits Foreign Nationals from holding Right of Ownership (Hak Milik) over land pursuant to the principle of nationality, allowing only the Right of Use (Hak Pakai) under specific statutory conditions. Disputes typically arise from the practice of nominee agreements (utilizing Indonesian citizens as proxies) to circumvent restrictions and gain control over land. The Panel of Judges at the Gianyar District Court ruled that the nominee agreement constituted a form of legal evasion (penyelundupan hukum) that violated the requirement of a lawful cause (causa yang halal); consequently, the agreement was declared null and void ab initio, and the title certificate held under the name of the Indonesian citizen was declared valid. In Malaysia, land ownership is governed by various statutes, including the National Land Code (NLC) 1965, which regulates land rights, registration, and land tenure. In a landmark Malaysian case, the Federal Court of Malaysia in Tan Yin Hong v. Tan Sian San & Ors [2010] 2 MLJ 242 officially overruled the controversial precedent of Adorna Properties (2001), reaffirming legal protection for the original titleholder—ruling in favor of the foreign purchaser and demonstrating state protection for foreign property buyers. In Malaysia, Foreign Nationals are openly permitted to acquire real estate and land properties (under Freehold or Leasehold status), whereas Indonesia maintains a significantly stricter framework that prohibits Foreign Nationals from acquiring property under absolute ownership rights.
