This research aims to analyze the regulation of marital property under Indonesian law, the legal authority to grant marital property and the legal status of deeds of gift executed by Land Deed Officials (Pejabat Pembuat Akta Tanah), and the legal implications for the recipient of a gift following the annulment of a deed of gift involving marital property, as examined in the Decision of the Malang Regency Religious Court Number 5171/Pdt.G/2022/PA.Kab.Mlg. This research examines the regulation of joint marital property under Indonesian positive law, the legal authority of a grantor to grant joint marital property and its implications for the legal status of a grant deed executed before a PPAT, as well as the legal consequences of annulling such a deed for the grantee, with reference to the aforementioned court decision. This research employs a normative juridical method using statutory and case approaches. The data consist of primary and secondary legal materials obtained through library research and analyzed qualitatively. The findings indicate that, pursuant to Article 35 paragraph (1) and Article 36 paragraph (1) of Law Number 1 of 1974 concerning Marriage, as amended by Law Number 16 of 2019, property acquired during marriage constitutes joint marital property, and legal dispositions thereof require the consent of both spouses. These provisions are further reflected in Articles 85 and 92 of the Compilation of Islamic Law. Under Article 36 paragraph (1) of the Marriage Law and Article 92 of the Compilation of Islamic Law, a spouse may not grant joint marital property without the consent of the other spouse. Meanwhile, Article 37 paragraph (1) of Government Regulation Number 24 of 1997 concerning Land Registration provides that the transfer of land rights by way of a grant must, in principle, be evidenced by a deed executed before a PPAT. The annulment of the grant deeds, as declared in the aforementioned court decision, renders the deeds legally ineffective and affects the grantee’s legal basis for asserting rights over the disputed land.
